Vital Amine, Inc. d/b/a Ora Organic (“Ora,” “we,” “us” or “our”) operates the website at ora.organic and the related online store, subscriptions, emails, text messages, customer support and other services (together, the “Services”). This Privacy Policy describes how we collect, use and disclose your personal information when you visit, use or make a purchase through the Services, sign up for our emails or text messages, contact us, or otherwise communicate with us. It replaces all earlier versions of our privacy policy.

Please read it carefully. By using the Services you acknowledge that your personal information will be handled as this Privacy Policy describes. Your use of the Services is also subject to our Terms of Service.

Changes to this Privacy Policy

We may update this Privacy Policy from time to time, including to reflect changes to our practices or for other operational, legal or regulatory reasons. We will post the revised version here and update the “Last updated” date. Where the law requires it, we will notify you of material changes in advance, for example by email.

Personal information we collect

“Personal information” means information that identifies, relates to or can reasonably be linked to you. It does not include information that has been de-identified or aggregated so that it no longer identifies you. The information we collect depends on how you interact with us.

Information you give us

  • Contact details, such as your name, billing and shipping address, email address and phone number.
  • Order and subscription information, such as the products you buy, your subscription plan and delivery frequency, your order history and returns.
  • Payment information. Payments are processed by our payment processors and by Shopify. We do not store your full card number.
  • Account information, such as your login details and your preferences.
  • Customer support information, such as what you tell us by email, phone, chat or our contact form.
  • Quiz and survey answers, such as the wellness goals you tell us about when you use a product recommendation quiz.
  • Content you share, such as reviews, ratings, photos and videos, and comments or posts that tag us on social media.
  • Referral information, such as a friend’s email address when you refer them to us. Please only refer people who you believe would like to hear from us.
  • Job applications, such as your resume and the information you send with it.

Information we collect automatically

When you use the Services we and our partners automatically collect information about your device and how you use the Services, such as your IP address, approximate location derived from it, browser and device type, the pages and products you view, the links you click, how you arrived at the Services, and the time and date of your visit. We collect it with cookies, pixels, software development kits and similar technologies (together, “cookies”). Some of these tools record how visitors move, scroll and click on our pages so that we can find and fix problems with the site. See Cookies and similar technologies below.

Information we receive from others

We receive information about you from Shopify and our other service providers, such as the companies that help us process payments, fulfill and ship orders, manage subscriptions and provide customer support; from advertising and analytics partners; from social media platforms when you interact with our pages or posts; from partners and creators whose discount codes or links you use; and from Truemed if you use HSA/FSA funds.

Health-related information

We sell dietary supplements, so some of the information described above, such as the products you buy, your answers to a recommendation quiz or what you tell our support team, may suggest something about your health or wellness goals. We use that information to provide the Services, including fulfilling your orders, recommending products and answering your questions. We do not sell it for money. If you buy with HSA/FSA funds, the health information needed to confirm eligibility is collected by Truemed, not by us, under Truemed’s own privacy policy.

How we use your personal information

  • To provide the Services: to process payments, fulfill and ship orders, manage your account and subscriptions, handle returns and refunds, send order and shipping updates, and provide customer support.
  • For marketing and advertising: to send you emails and, with your consent, text messages; to show you advertising on other websites and apps; and to measure how our marketing performs. You can opt out at any time, as described in Your rights and choices.
  • To keep the Services secure: to authenticate your account, detect and prevent fraud and other harmful activity, and protect our customers and our business.
  • To improve the Services: to understand how people use the Services, test new features and prices, fix problems, and develop new products.
  • For legal reasons: to comply with the law and with legal requests, enforce our terms, and protect our rights and the rights of others.

Cookies and similar technologies

We use cookies to run the store (for example, to keep items in your cart and keep you signed in), to remember your preferences, to understand how the Services are used, and to show and measure advertising. Some cookies are placed by Shopify and some by third parties, including analytics, session-recording and advertising partners such as Google, Meta, TikTok, Pinterest, Reddit, Microsoft, AppLovin, MNTN and Tatari.

You can choose which kinds of cookies to allow through the cookie banner, or at any time through the Your Privacy Choices link in the footer of every page. Most browsers also let you block or delete cookies, although parts of the store may not work without them. If your browser sends a Global Privacy Control (GPC) signal, we treat it as a request to opt out of the sale or sharing of your personal information for that browser, where applicable law requires it.

How we disclose your personal information

We disclose personal information for the purposes described above to the following kinds of recipients:

  • Service providers that process information on our behalf, including Shopify (our e-commerce platform), payment processors, our fulfillment and shipping partners and carriers, and the providers we use for subscriptions (Stay.ai), email and onsite forms (Klaviyo), text messages (Postscript), reviews (Yotpo), customer support (Gorgias), returns (Loop), product recommendations and promotions, referrals (Friendbuy), cookie consent (Consentmo), quizzes, forms, hosting and analytics.
  • Advertising and analytics partners, such as those named in the cookies section above, which use information about your activity on the Services to show you ads, measure their results and improve their services.
  • Payment and benefits partners you choose to use, such as Shop Pay or Truemed for HSA/FSA purchases.
  • Partners and creators, who may receive limited information, such as that an order used their code, so we can pay them.
  • Others when you direct us to, such as when you post a review or link a social media account.
  • For legal reasons and business transfers: to comply with the law or legal process, to protect rights, property and safety, and in connection with a merger, acquisition, financing, bankruptcy or sale of all or part of our business.

We do not sell personal information for money. Some of the disclosures to advertising partners described above may count as a “sale” or “sharing” of personal information, or as “targeted advertising,” under some US state laws. You can opt out as described below.

Shopify

Our store is hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve them for you. Information you submit through the Services is transmitted to and shared with Shopify, and with third parties that may be located in countries other than where you live, for the same purpose.

To help protect, grow and improve our business, we also use certain Shopify features that draw on information about your interactions with our store, with other merchants and with Shopify itself, such as fraud prevention, Shop Pay and the Shop app. For those features, Shopify is responsible for how it processes your personal information, including responding to requests to exercise your rights over that use. To learn more, see the Shopify Consumer Privacy Policy. Depending on where you live, you can exercise certain rights over that information through the Shopify Privacy Portal.

Text messages

If you sign up for text messages we collect your mobile number, your consent and the history of messages between us. Message frequency varies and message and data rates may apply. Reply STOP to any message to opt out, or HELP for help. Consent to receive marketing text messages is not a condition of any purchase. We do not share or sell your mobile number or your text messaging opt-in data or consent with third parties for their own marketing purposes. The Messaging Terms & Conditions in our Terms of Service and our Messaging Privacy Policy apply to the text message program.

Reviews and other content you share

Reviews, ratings, photos and other content you post through the Services or share with us may be public, and anyone can see them. Our Terms and Conditions for User Generated Content, below, explain how we may use content you make available to us.

Third-party websites and links

The Services may link to websites and services we do not operate, such as social media platforms, Truemed and our partners’ pages. Their privacy practices are their own, and we encourage you to read their policies.

Children’s data

The Services are not intended for children, and we do not knowingly collect personal information from children under 13. You must be 18 or older, or have a parent or guardian’s consent, to buy from us. We do not knowingly sell or share the personal information of anyone under 16. If you believe a child has given us personal information, contact us and we will delete it.

Security and retention

We use reasonable administrative, technical and physical safeguards to protect personal information, but no method of transmission or storage is completely secure. We keep personal information for as long as we need it for the purposes described here, such as to maintain your account, provide the Services, meet our legal and accounting obligations, resolve disputes and enforce our agreements, and then delete or de-identify it.

Your rights and choices

Depending on where you live, you may have some or all of the following rights:

  • Access / know: to ask what personal information we hold about you and how we use and disclose it.
  • Delete: to ask us to delete personal information we hold about you.
  • Correct: to ask us to correct inaccurate personal information.
  • Portability: to receive a copy of your personal information in a portable format.
  • Opt out of sale, sharing and targeted advertising: through Your Privacy Choices, the cookie banner, or a Global Privacy Control signal.
  • Withdraw consent: where we rely on your consent, you can withdraw it at any time.
  • Appeal: if we decline your request, you can appeal by replying to our decision. If we deny your appeal, you may contact your state attorney general.

We will need to verify your identity, usually by matching information you give us to information we already hold, and we will respond within the time the law requires. You may use an authorized agent to make a request for you; we may ask the agent for proof that you authorized them. We will not discriminate against you for exercising any of these rights.

Marketing. You can unsubscribe from marketing emails using the link in any email, and from text messages by replying STOP. We may still send you messages about your orders and account.

Additional information for California residents

In the past 12 months we have collected the following categories of personal information, from the sources and for the purposes described above: identifiers (such as name, email address, phone number and IP address); customer records (such as address and payment details); commercial information (such as purchase and subscription history); internet and other electronic network activity (such as browsing and interaction with the Services and our ads); approximate geolocation; audio and electronic information (such as customer support communications); and inferences drawn from the above (such as product preferences). We disclose these categories to the recipients described in How we disclose your personal information. Identifiers, commercial information, internet activity and inferences may be disclosed to advertising partners in a way that is a “sale” or “sharing” under California law. We do not use or disclose sensitive personal information for purposes that would give you the right to limit it. California residents may also ask, once a year, for information about our disclosure of personal information to third parties for their direct marketing purposes.

Notice of financial incentive. We sometimes offer discounts, free gifts or other benefits in exchange for signing up for our emails or text messages, subscribing, or referring a friend. Taking part is optional, and the terms of each offer are shown when it is presented. We consider the value of your personal information to be reasonably related to the value of the offer, based on our estimate of the expense we incur in providing it. You can withdraw at any time by unsubscribing or opting out as described above.

International users

We are based in the United States, and your personal information will be processed in the United States and in other countries where our service providers operate, which may not have the same data protection laws as your country. Where required, we rely on recognized transfer mechanisms, such as standard contractual clauses, for these transfers. If you are in the United Kingdom or another country with a law similar to the GDPR, we process your personal information to perform our contract with you, for our legitimate interests in running and improving our business, with your consent (which you may withdraw at any time), and to comply with our legal obligations, and you have the rights listed above as well as the right to object to and restrict certain processing.

Terms and Conditions for User Generated Content

Vital Amine Inc. d/b/a Ora Organic (“Ora”, “we” or “us”) would like to use your images, photographs, videos, and other media, as well as associated material, including your name, images, voice, likeness, social media usernames, and other biographical material that you make available (collectively, the “Content”) as described below.

Thank you for letting Ora share your Content with the world! By making available any Content to Ora (including by posting Content on any Ora platform or any social media page maintained by Ora, or by posting Content with any hashtag publicized by Ora), or by otherwise indicating your acceptance, you are agreeing to these terms and conditions (the “Agreement”). You affirm that you are of legal age to enter into this Agreement, or, if you are not, that you have obtained parental or guardian consent to enter into this Agreement. This Agreement hereby incorporates by this reference any additional terms and conditions posted by Ora through its website at ora.organic, or otherwise made available to you by Ora. SUCH TERMS AND CONDITIONS INCLUDE DISCLAIMERS AND LIMITATIONS OF LIABILITY, AS WELL AS A MANDATORY ARBITRATION PROVISION THAT REQUIRES THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS, RATHER THAN JURY TRIALS OR ANY OTHER COURT PROCEEDINGS, OR CLASS ACTIONS OF ANY KIND.

  1. License. For the purposes of clarity, you retain ownership of your Content. You hereby grant to Ora a worldwide, royalty-free, non-exclusive, perpetual, transferable and fully sublicensable (through multiple tiers) license, without additional consideration to you or any third party, to reproduce, distribute, perform and display (publicly or otherwise), create derivative works of, adapt, modify and otherwise use your Content, in any format or media now known or later developed, including for marketing, publicity, promotion and exhibition purposes.

    If you no longer want your Content used by Ora going forward, as described in this paragraph, you may notify us by email sent to info@ora.organic, stating your request and identifying the applicable Content. Within a reasonable time after receiving such notice, Ora will use reasonable efforts to stop using such Content for any new use (e.g., in any new social media post or new advertising campaign); provided, however, that Ora reserves the right to continuing using such Content for any existing use, and, for clarity, is under no obligation to delete or restrict any copies of Content already created or made available.

    You represent and warrant that you have all rights necessary to grant this license, that your Content is complete and accurate and is not fraudulent, tortious or otherwise in violation of any applicable law or any right of any third party, including publicity and privacy rights, and that you have obtained (and, upon request by Ora, will provide to Ora written copies of) any necessary waivers and consents from third persons whose name, image, voice, likeness or other material appear in your Content. You further irrevocably waive any “moral rights” or other rights with respect to attribution of authorship or integrity of materials regarding the Content that you may have under any applicable law under any legal theory.

  2. Personal Information. You acknowledge that your personal information will be subject to our Privacy Policy, currently available at ora.organic/pages/privacy. To the extent that any personal information of third persons is included in your Content, you represent and warrant that you have obtained all necessary consents from such third persons to make their personal information available subject to our Privacy Policy.

  3. General. This Agreement does not create any partnership, joint venture, employer-employee, agency or franchisor-franchisee relationship between you and Ora. If any provision of this Agreement is found unenforceable for any reason, that provision will be deemed severable from this Agreement and will not affect the validity and enforceability of any remaining provision. This Agreement contains all the terms of our agreement relating to its subject matter.
